Sample Limited Home Warranty

1. homeowners manual should be specifically referenced in your contract with the homeowner/purchaser

2. It should include:

  • A listing of subcontractors and contact numbers
  • Details of a limited warranty
    • Specific address of home
    • Notation that “limited warranty excludes consequential damages, limits the duration of implied warranties, and provides for liquidated damages”
    • What is covered by the warranty, including:

      a)     missing hardware
      b)     sticking doors, drawers, windows
      c)     dripping faucets
      d)     other malfunctions reported by buyer upon       inspection of the property

    • What is not covered, including

      a)     Acts of God
      b)     alterations, misuse or abuse by any person    after occupancy
      c)     damage resulting from buyer’s failure to observe any operating instructions
      d)    damage from malfunction of utilities
      e)    items furnished or installed by buyer
      f)     items listed in non-warrantable conditions

      g)    appliance or equipment warranties

  • The Only Warranty Given by the Builder
  • List of non-warrantable conditions attached to and made a part of Limited Warranty including:
    • Development of non-structural cracks in concrete foundations, walks, drives, and patios due to expansion or contraction
    • Development of cracks in Masonry stucco and mortar due to shrinkage in the stucco, mortar or brick
    • Cracks in wood due to the drying out process
    • Nail pops or settlement cracks in Drywall
    • Floor Squeaks
    • Damage to floors caused by neglect or the incidents of use
    • Cracking and bleeding of caulking
    • Discoloration of brick due to the elements, rain water run-off, weathering, or bleaching
  • List of non-warrantable conditions attached to and made a part of Limited Warranty including (continued):
    • any broken glass or mirrors which are not noted on the final inspection
